Determining Jurisdiction -- It's About Time...and People

The Florida Safe Drinking Water Act (SDWA) uses the term "non-transient population" to designate people who consume water from the same system for more than 6 months per year. An example would be a business that employs 25 or more people; the "non-transients" are the permanent employees. Another example would be a school that has 25 or more students who are attending classes for more than 60 days. If there are at least 25 persons who orally consume water more than 60 days/year then the water system is regulated by the Department of Environmental Protection under the SDWA. Oral consumption is assumed if the non-transient population (such as students in a school or employees of a business) have access to a sink tap.

coffee Transients may be customers, seasonal visitors, and employees who work less than 60 days per year. To count transients as population served, piped water must be made available for oral consumption - - e.g., through a water fountain, cups, or beverages made with water or when water is used for preparing food or in dishwashing.
house Are there 25 or more of the same persons served year-round? (A year is defined as being greater than nine months.) If YES, then the water system is regulated by the Department of Environmental Protection under the SDWA. If NO, and there is no transient population consuming the water, then it is under the jurisdiction of Chapter 64E-8, F. A. C., and the Department of Health.
house Are there 25 or more persons served 60 days to six months/year? If YES, then the water system is regulated by the Department of Environmental Protection under the SDWA. If NO, and there is no transient population consuming the water, then it is under the jurisdiction of Chapter 64E-8, F. A. C., and the Department of Health. (Recreational vehicle parks and camp grounds are assumed to cater to a population that remains less than six months/year)
trailer Are there 25 or more of the same persons served six to nine months/year? If YES, then the water system is regulated by the Department of Environmental Protection under the SDWA. If NO, and there is no transient population consuming the water, then it is under the jurisdiction of Chapter 64E-8, F. A. C., and the Department of Health. (Trailer parks are assumed to cater to populations that remain more than six months per year.)
